The terms for using 58th Floor AI Video: accounts, credits and subscriptions, photo and likeness rules, acceptable use, and your AI-generated rap videos.

1. Acceptance of These Terms

By creating an account or using 58th Floor AI Video (the "Service", at 58th-floor.com), you agree to these Terms of Service ("Terms"). Please read them carefully before using the Service. If you do not agree, do not use the Service.

2. What the Service Is

58th Floor AI Video is an AI video maker. You upload a photo of each of two people (or one photo showing both), pick a set, and optionally enter a short topic for the lyrics. An AI video model then renders a short video of the two of you rapping together, with AI-generated rap vocals and beat. You can also apply single-photo photo effects, such as Earth Zoom Out or Hug, and upload your own track or dance clip.

Rendering is performed by third-party AI providers accessed through an API aggregator; files are stored in cloud object storage.

Automated safety checks review the lyric topic, the photos, and the finished video. Flagged inputs are stopped before anything is charged; a flagged video is withheld and its credits returned. If a model is temporarily unavailable, we may render your video with an equivalent or better model at the same credit cost.

We may add, change, or remove features, sets, effects, and providers at any time; where a change materially reduces the Service, we will give reasonable notice when practical.

3. Accounts

  • You can sign in with email, or with Google if Google sign-in is enabled for your account.
  • You must provide accurate information and keep your credentials confidential. Activity under your account is your responsibility; tell us promptly about any unauthorized use.
  • You must be at least 13 years old (or the higher minimum age required where you live) to use the Service.
  • One person may not operate multiple accounts to claim a free preview more than once. We may block such attempts and close those accounts.

4. Photos and Likeness

This section matters most. By uploading a photo you confirm that:

  • the photo shows you, or a person who has given you permission to use their likeness in this way;
  • you will not upload photos of minors without their parent or guardian's consent;
  • you will not use photos of public figures or celebrities to impersonate them;
  • the resulting video will not be used to create or spread content that is sexual, hateful, harassing, or defamatory, or that is intended to deceive — for example, passing the video off as real footage of a real person saying things they never said.

You are responsible for how you share the videos you create. We may refuse to render, remove content, and suspend or terminate accounts that break these rules, without refund of used credits.

5. Credits and Payment

  • The Service is paid for with credits, bought in one-time credit packs or received through subscriptions. Payments are processed by our payment providers. Prices and offers may change, and different visitors may be shown different offers; the price shown at checkout applies.
  • What a video costs. Before each render you choose the model, set, resolution, length, and shape, and the credit cost is shown on the Create button. Every option shows its credit price up front. Credit costs may change; the cost shown before you render applies.
  • Credits expire according to your plan. Credits from a one-time pack do not expire. Monthly plan credits expire at the end of that billing month, and yearly plan credits at the end of the billing year, so the whole year's credits are granted at the start of the billing year. Unused plan credits do not roll over.
  • Pack credits and plan credits share one balance; the credits that expire soonest are used first.
  • Canceling: you can cancel any time from Settings → Billing. Canceling stops the next renewal; your plan stays active, with its credits, until the end of the period you have paid for. We do not give prorated refunds for partial periods, except as described in the Refund Policy.
  • Credits cannot be transferred or exchanged for cash, except as described in the Refund Policy.
  • Failed renders are never charged: if a render errors, is refused by a safety filter, or times out, any prepaid credits return to your balance automatically. A render that completes but that you don't like is not a failure.

6. Acceptable Use

In addition to Section 4, you agree not to use the Service to:

  • create sexual content, or any content sexualizing a minor or anyone who appears to be a minor — absolutely and without exception;
  • infringe copyright, trademark, publicity, or other rights of any party;
  • create content that is illegal where you live or where we operate, promotes violence or self-harm, or constitutes harassment, hate, or fraud;
  • probe, overload, scrape, or interfere with the Service or its providers, or circumvent safety filters, rate limits, or the free-preview limits.

7. Your Content and Generated Videos

  • Your uploads remain yours. You grant us a limited license to host and process them solely to operate the Service — sending them to AI rendering providers to render your videos. We do not use them to train our own models.
  • Generated videos are AI-generated, including the lyrics, vocals, and beat. Subject to these Terms and to third-party rights (including the rights of the people depicted), we grant you a license to use your generated videos for personal and commercial purposes.
  • AI models can produce similar outputs for different users; we cannot guarantee uniqueness, and you are responsible for verifying that your use does not infringe third-party rights.
  • You can request deletion of your photos and videos at any time by emailing support@58th-floor.com.

8. Availability

The Service is provided on a best-effort basis: we do not guarantee uninterrupted availability, rendering speed, or that any given set, effect or provider remains offered. Render times shown on the Create button are estimates.

9. Termination

You may stop using the Service and request account deletion at any time by emailing support@58th-floor.com; if you have an active subscription, cancel it from Settings → Billing to stop future renewals. We may suspend or terminate accounts that breach these Terms, abuse the free preview, initiate fraudulent chargebacks, or create risk for the Service, other users, or people depicted in content. Sections 4, 6, 7, 10, and 11 survive termination.

10. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. To the maximum extent permitted by law, our total liability arising out of the Service is limited to the amounts you paid us in the twelve months before the claim; we are not liable for indirect, incidental, or consequential damages. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

11. Changes to These Terms

We may update these Terms from time to time. The date above reflects the latest revision, and material changes will be announced in the product. Continued use after a change takes effect constitutes acceptance.
